Replay Tech Inc. (“Replay,” “we,” “us,” or “our”) operates Replay Glasses, the Replay mobile and web applications, Replay APIs, this online store, and all related information, content, features, tools, products, and services collectively referred to as the “Services.”

Replay Glasses are audio-first smart glasses that allow you to intentionally record conversations, meetings, and other moments. Replay is not always recording. A recording begins only when you start it using the controls on the glasses and ends when you stop it. Replay Glasses do not capture photos or video.

Recordings can be transferred to the Replay mobile app and processed to create audio recordings, speaker-separated transcripts, titles, summaries, key takeaways, suggested questions, and other AI-generated information. You can access this content through the Replay mobile app, web app, and, if enabled, the Replay API. We refer to this information collectively as “Recording Content.”

Our online store is powered by Shopify, which enables us to sell and fulfill Replay products. This Privacy Policy describes how we collect, use, disclose, protect, and retain personal information when you visit our store, purchase a product, use Replay Glasses or the Replay apps and APIs, or otherwise communicate with us.

If there is a conflict between our Terms of Service and this Privacy Policy concerning the collection, use, or disclosure of personal information, this Privacy Policy controls.

Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understood the practices described in this Privacy Policy.

Personal Information We Collect or Process

When we use the term “personal information,” we mean information that identifies you or can reasonably be linked to you or another person. Personal information does not include information that has been collected anonymously or de-identified so that it can no longer reasonably be linked to an individual.

Depending on how you interact with Replay, where you live, and what features you use, we may collect or process the following categories of personal information:

  • Contact information, including your name, email address, telephone number, billing address, shipping address, and other contact details.

  • Account information, including your name, email address, account identifier, preferences, settings, subscription information, and authentication information. Replay uses an authentication provider to process login credentials and does not store your plaintext password in Replay’s application database.

  • Commerce and transaction information, including products you view, add to your cart, purchase, return, exchange, or cancel; order history; shipping details; payment status; and related transaction information. Shopify and its payment providers process payment card information. Replay generally receives transaction details and payment confirmation rather than your complete payment card number.

  • Recording Content, including audio recordings, transcripts, speaker labels, recording titles, summaries, key takeaways, suggested questions, timestamps, recording duration, and other content derived from a recording. Recording Content may contain personal information about you and other people whose voices or statements are captured.

  • AI interaction information, including questions you ask Replay, chat messages, chat history, generated responses, and the recordings or transcripts referenced when responding to your questions.

  • Optional voice enrollment information, including an audio sample of your voice and temporary mathematical representations of voice characteristics used to identify your voice within your recordings and label you in transcripts. Depending on applicable law, this information may be considered biometric information. Replay does not store the temporary voice representation separately after processing. The enrollment audio sample may be retained while you use speaker matching.

  • Device information, including the identifier associated with your Replay Glasses, Bluetooth identifier, firmware version, battery status, charging status, recording status, number of recordings awaiting transfer, mobile device information, operating system, browser, network connection, IP address, and similar identifiers.

  • API information, including API key names, creation dates, last-used dates, API requests, and information accessed through the Replay API. Replay stores a one-way hash of a public API key rather than storing the complete key after it is initially displayed to you.

  • Communications with us, including information included in customer-support requests, emails, feedback, surveys, or other communications.

  • Usage and diagnostic information, including how and when you use the Services, pages and features you access, app performance, crashes, error reports, logs, and related technical information. Replay uses Sentry to help diagnose errors and improve reliability. On the mobile app, this may include sampled session replays that record app screens and interactions for troubleshooting.

  • Cookie and advertising information, including information collected through cookies, pixels, Shopify customer events, and similar technologies used to operate the store, remember preferences, measure performance, understand purchases, and deliver or measure advertising.

Personal Information About Other People

Recording Content may include the voices, statements, names, or other personal information of people other than the Replay account holder.

You are responsible for using Replay lawfully and for providing any notice and obtaining any consent required before recording, uploading, transcribing, or otherwise processing another person’s information. Recording and consent laws differ by jurisdiction. Do not use Replay to record a person or conversation when doing so is prohibited.

Personal Information Sources

We may collect personal information from the following sources:

  • Directly from you when you create an account, purchase a product, pair Replay Glasses, create or sync a recording, enroll your voice, ask Replay a question, contact us, or otherwise use the Services.

  • From Replay Glasses and the Replay mobile app when you pair a device, check device status, transfer a recording, or use other device features.

  • Automatically through cookies, software development kits, logs, analytics, diagnostic tools, and similar technologies when you use our store, apps, website, or APIs.

  • From service providers that help us operate the Services, including Shopify, payment providers, authentication and hosting providers, transcription and AI providers, analytics and diagnostic providers, fulfillment partners, and shipping carriers.

  • From business partners or other third parties as permitted by applicable law.

How We Use Personal Information

We may use personal information to:

  • Provide, operate, maintain, and improve the Services. This includes creating and managing accounts, pairing Replay Glasses, transferring recordings, storing Recording Content, transcribing audio, identifying speakers, generating summaries and titles, answering questions about recordings, providing search, and making recordings available through the mobile app, web app, or API.

  • Process purchases, payments, subscriptions, returns, exchanges, and refunds; arrange shipping and fulfillment; communicate order status; and provide customer support.

  • Process optional voice enrollment information to help identify your voice within recordings associated with your account and label the corresponding transcript speaker. We do not use the voice enrollment sample for advertising or to identify you outside the Replay Services.

  • Monitor performance, troubleshoot errors, prevent abuse, improve reliability, understand how features are used, and develop or improve the Services.

  • Authenticate users, protect accounts, detect and investigate fraudulent, unauthorized, illegal, unsafe, or malicious activity, enforce our policies, and maintain the security of the Services.

  • Send service-related messages and, where permitted, marketing or promotional communications. You may unsubscribe from promotional emails at any time. We may still send non-promotional communications about your account, orders, recordings, subscriptions, security, or changes to the Services.

  • Comply with applicable law, respond to valid legal process, enforce our agreements, resolve disputes, protect our rights or the rights of others, and participate in legal or regulatory proceedings.

How Replay Uses AI and Transcription Providers

Replay uses third-party service providers to process Recording Content.

Replay sends audio to AssemblyAI to create transcripts and separate speakers. Replay may then send transcripts, summaries, questions, relevant recording context, and chat history to OpenAI through its API to generate titles, summaries, key takeaways, suggested questions, search results, and responses to your questions.

These providers process information according to their agreements with Replay, our service configurations, and their applicable privacy and data-retention terms. OpenAI states that information submitted through its API is not used to train its models by default unless the customer expressly opts in.

Replay does not use Recording Content or voice enrollment samples for targeted advertising. We do not sell Recording Content or voice enrollment information to data brokers or advertisers.

How We Disclose Personal Information

We may disclose personal information:

  • To Shopify and its payment providers to operate our store, process payments, provide checkout, prevent fraud, and fulfill purchases.

  • To cloud, database, authentication, storage, and processing providers, including Supabase, Google Cloud, and Modal, to host and operate the Services.

  • To AssemblyAI for transcription and speaker separation.

  • To OpenAI for AI-generated features, including titles, summaries, key takeaways, suggested questions, search, and chat responses.

  • To Sentry to monitor performance, investigate errors, and improve the Services.

  • To fulfillment providers, shipping carriers, customer-support providers, professional advisers, and other vendors that perform services on our behalf.

  • To marketing and advertising partners to operate and measure advertising. Recording Content, transcripts, summaries, AI conversations, and voice enrollment information are not disclosed for targeted advertising.

  • When you direct us to do so or consent to the disclosure, including when you create an API key or connect Replay to another service.

  • Within our corporate group or in connection with a merger, financing, acquisition, bankruptcy, sale of assets, or similar business transaction.

  • To comply with applicable law, respond to subpoenas, court orders, warrants, or other valid legal requests, enforce our terms and policies, prevent harm, and protect Replay, our users, or others.

Relationship with Shopify

Our store is hosted by Shopify. Shopify collects and processes personal information about your access to and use of the store to provide and improve its services, process transactions, prevent fraud, and support advertising and analytics features.

Information submitted through the store may be transmitted to Shopify and other providers located outside the country where you live. Shopify may also use information about your interactions with our store, other merchants, and Shopify services to provide enhanced commerce and advertising features.

Cookies and Similar Technologies

We and our service providers use cookies, pixels, software development kits, Shopify customer events, and similar technologies to operate the Services, remember preferences, maintain sessions, understand usage, measure store performance, prevent fraud, and provide or measure advertising.

Depending on where you live, you may be able to manage non-essential cookies through the cookie controls provided on the store or through your browser settings. Blocking cookies may prevent certain features from working correctly.

Third-Party Websites and Services

The Services may contain links to websites, apps, or platforms operated by third parties. If you follow a third-party link or use a third-party integration, that third party’s privacy policy and terms apply.

We do not control and are not responsible for the privacy, security, accuracy, or reliability of unaffiliated third-party services. The inclusion of a link does not necessarily mean Replay endorses the third party.

Security of Your Information

Replay uses administrative, technical, and organizational safeguards designed to protect personal information from unauthorized access, loss, misuse, alteration, and disclosure.

Our security practices include:

  • Communications between Replay’s apps, websites, APIs, and cloud services over public networks use HTTPS and Transport Layer Security.

  • Replay’s core cloud storage and infrastructure providers apply provider-managed encryption to customer data stored at rest.

  • When recordings are transferred from Replay Glasses to the mobile app, the phone connects directly to a password-protected local Wi-Fi network created by the glasses.

  • The mobile app uploads selected recordings to Replay’s cloud storage over HTTPS. Following a successful cloud transfer, the synced recording is removed from the glasses.

  • Replay uses token-based account authentication.

  • Recording files are accessed through authenticated storage requests or, for the Replay public API, time-limited signed links.

  • Public API keys are randomly generated, stored in hashed form, limited to the account that created them, and can be revoked.

  • Replay limits access to personal information to systems, personnel, and service providers that require access to operate, support, secure, or improve the Services.

  • Temporary working files created in Replay’s cloud processing environment are removed after processing is completed.

Replay is not end-to-end encrypted. Authorized Replay systems and service providers must be able to process Recording Content in readable form to transcribe recordings, generate summaries, answer questions, and provide other requested features.

No security system is perfect or impenetrable, and we cannot guarantee absolute security. You are responsible for keeping your password, device, and API keys secure. Do not share account credentials or API keys with other people, and do not send sensitive information to Replay through unsecured communication channels.

Retention and Deletion

We retain personal information for as long as reasonably necessary to provide the Services, maintain your account, fulfill purchases, comply with legal obligations, resolve disputes, prevent fraud, enforce agreements, and support other legitimate business purposes.

Recording Content is generally retained until you delete the applicable memory or request its deletion. Deleting a memory initiates deletion of its stored audio and associated generated content from Replay’s active systems. Residual copies may remain temporarily in backups, logs, or service-provider systems before being deleted under applicable retention schedules.

Successfully synced recordings are removed from Replay Glasses after upload. Recordings that have not been synced remain on the glasses until they are transferred, manually deleted, or otherwise removed.

Optional voice enrollment samples may be retained while you use speaker matching or maintain a paired Replay device. You may request deletion of your voice enrollment sample by contacting us.

AI chat messages and conversation history may be retained until you delete the conversation or request deletion. Commerce and transaction records may be retained for longer periods when required for tax, accounting, fraud-prevention, warranty, or legal purposes.

Our service providers may retain limited copies of information in accordance with their agreements, security requirements, backup processes, and legal obligations.

If you use Replay’s in-app account deletion control, access to the account is deactivated. You may contact us to request deletion of associated Recording Content, voice enrollment information, chat history, or other retained personal information.

Children’s Data

The Services are not intended for children under the age of majority in their jurisdiction, and we do not knowingly allow children to create Replay accounts without appropriate authorization.

Recording Content may incidentally include information about a child if an account holder records a conversation involving that child. Account holders are responsible for obtaining any authorization required by law before recording or processing a child’s information.

If you are a parent or guardian and believe a child has provided personal information to Replay without appropriate authorization, contact us to request its deletion. We do not knowingly sell or share the personal information of individuals under 16 for targeted advertising.

Your Rights and Choices

Depending on where you live, you may have the right to:

  • Request access to personal information we maintain about you.

  • Receive information about how your personal information is used.

  • Correct inaccurate personal information.

  • Obtain a portable copy of your personal information.

  • Request deletion of your personal information.

  • Withdraw consent to certain processing.

  • Object to or restrict certain processing.

  • Appeal a decision we make concerning a privacy request.

  • Opt out of the sale or sharing of personal information or its processing for targeted advertising, as those terms are defined by applicable law.

You may delete individual recordings and chat conversations through available Replay controls. You may revoke public API keys through your account settings. You may request deletion of a voice enrollment sample or other account information by contacting us.

You may unsubscribe from promotional emails using the unsubscribe link included in those messages. Even if you unsubscribe, we may continue to send service-related messages about your account, purchases, subscriptions, security, or use of Replay.

You may exercise applicable rights through controls provided in the Services or by contacting us using the information below. We may need to verify your identity before completing a request. Where permitted by law, you may designate an authorized agent to submit a request on your behalf.

We will not discriminate against you for exercising an applicable privacy right.

Complaints

If you have a complaint about how Replay processes personal information, contact us using the information below.

Depending on where you live, you may also have the right to appeal our response or submit a complaint to your local data protection or privacy authority.

International Transfers

Replay and its service providers may transfer, store, and process personal information outside the country where you live, including in the United States.

Where required, transfers from the European Economic Area, United Kingdom, or Switzerland will rely on recognized safeguards such as adequacy decisions, Standard Contractual Clauses, the United Kingdom International Data Transfer Addendum, or another lawful transfer mechanism.

Changes to This Privacy Policy

We may update this Privacy Policy periodically to reflect changes to the Services, our data practices, technology, legal requirements, or other operational reasons.

When we update this Privacy Policy, we will post the revised version, update the “Last updated” date, and provide any additional notice required by applicable law.
